Ohio Marriage Dissolution and Separation Agreement Attorneys: When You Both Agree
Instead of arguing over every detail of a divorce, many couples agree on solutions to the issues. When both spouses agree to everything, your attorney drafts a separation agreement (including property division) and a shared parenting plan. Since the two parties have made all the decisions, the court will not be making decisions for them. The court's role is to approve or disapprove the agreements.
This process is called dissolution and is unique in Ohio. At the law firm of Schimpf, Ginocchio, and Kehres Co., LPA, our lawyers are fluent in the language of the Ohio laws that govern divorces and dissolutions. We can assess your situation and determine if a dissolution of marriage petition may be the right choice for you and your family.
Dissolution Issues
The dissolution process provides the same results as a divorce, as the marriage is ended. However, there are many advantages of a dissolution that appeal to clients, including those who have children. Dissolution helps clients avoid conflict and confrontation, helping to minimize any additional stress placed on the two parties, as well as children of the marriage. Dissolution also allows clients to move through the divorce process quicker, is often much less expensive, and the parties can be nearly positive of the outcome (as long as the court approves the documents).
The types of issues that are included in a dissolution are the same as those in a divorce, just with a resolution that suits both parties. Parties agree on issues such as:
- Child custody and visitation
- Child support
- Division of property and assets
- Division of debt
- Spousal support (alimony)
Dissolution Requirements
In order to file a petition for dissolution, one of the parties must have resided in Ohio for at least six months immediately before filing the petition. The petition must also be filed in the proper venue, which is often the Ohio county in which a party lives. Make sure you each have a family law attorney on your side to ensure you have met all requirements.
